Credit Counseling and Bankruptcy Filing

Under the Bankruptcy Abuse and Consumer Protection Act of 2005 individuals who plan to file for bankruptcy must complete under Rule 11 U.S.C. Section 109 a Credit Counseling Course prior to filing a Chapter 7 or a Chapter 13 Bankruptcy Petition. Our office ensures that all clients comply with the counseling requirement and registers all clients for the course. The credit counseling costs are always included in or total legal fees charged by Sadek Bankruptcy Law Offices.

Clients may choose whether to take the course online or over the phone with a counselor at their convenience, twenty four hours a day, 7 days a week. The counseling session includes an evaluation of the individuals personal financial situation and proposes a budgeting plan. In preparation of the credit counseling course, one should have their most recent paystubs, list of debts and regular monthly expenses readily available. The counseling session generally lasts forty-five minutes. Over the years, my office has received great reviews about the credit counseling course and we all enjoy hearing a financial concept recently learned by our client(s). Upon completion of the credit counseling session a course certificate is generated, emailed to our law office and filed along with the bankruptcy petition. After filing bankruptcy, a second course and sequel, “Debtor Education” is required to receive a discharge in Bankruptcy. Our next Blog entry will discuss Debtor Education in greater detail.
