Whether filing a Chapter 7 Bankruptcy or a Chapter 13 Bankruptcy, the Petitioner(s) must attend a 341 Meeting of Creditors. Although named the Meeting of Creditors by Statute, it is extremely rare for a creditor to appear at the 341 Meeting. In the event a Creditor does appear, it is usually because they have additional questions regarding the Petitioners income, expenses, assets or liabilities listed on the bankruptcy filing or are seeking to raise an issue on dischargeability of debts. The 341 Meeting is held by a Trustee appointed to oversee a Bankruptcy case and routinely asks the following questions. The below list of question to expect at a 341 Meeting is only a sample and may vary on a case by case basis.

Identify your signature
Do you rent or own your home?
Are you married?
Are you employed?
Have you file for Bankruptcy before?
Do you have any credit cards in your possession?
Did you review the Petition before signing?
Is all real estate owned listed?
Is all your personal property listed?
Do you have any domestic support obligations?
Are all of your creditors listed in the schedules?
Why did you file for bankruptcy?
Are you expected any inheritances?
Do you have any pending lawsuits?

Although the answers to the aforementioned questions are listed in the bankruptcy petition, the Trustee is looking to make certain that the Petition is truthful, accurate and reflects the testimony at the 341 Meeting. Any changes in circumstances during the pendency must be brought to counsel’s attention to maintain accuracy of the bankruptcy petition.
