You can file for either Chapter 13 or Chapter 7 bankruptcy after a repossession. With Chapter 13, you start a payment plan which can help get your car back and keep it after. This is a quick process as you only have ten days to file in order to stop the lender from selling your car. If the car is sold, filing Chapter 13 will not get the car back. With the repayment plan, past-due car payments must be made to the creditor. Through negotiation, you and the lender can come to an agreement or you can redeem the vehicle. The lender may refinance the loan and work with you to catch up on payments. Companies, however, are not required to work with you and it will depend on the company in question to do so. Filing Chapter 7 prior to repossession can be beneficial and help prevent repossession completely. In four to six months, Chapter 7 can help get rid of all debt. When getting out of debt, you can begin to rebuild your financial well-being and begin saving for future emergencies and retirement.
