Consumer Bankruptcy Law

Chapter 13

Chapter 13 bankruptcy is a legal process in Center City that allows people to repay their debts over time while having the opportunity to keep valuable assets, like a home. We realize that nobody likes the idea of Bankruptcy, but a Chapter 13 Bankruptcy is a reorganization of debt contemporaneous with legal protections that are unfounded in any other area of law.

The most powerful aspect of a Bankruptcy is the automatic stay.  The automatic stay which can be found in 11 U.S.C Section 362 states in relevant part that no creditor can commence or continue collection efforts against a bankruptcy filer.

Meaning that as soon as a bankruptcy is filed, not do just phone calls stop, but lawsuits, judgment execution, foreclosure proceedings, and even sheriff sales on personal and real property are immediately halted.  This gives immediate financial relief to the bankruptcy filer and affords them a chance to restructure and reprioritize their debts.

Chapter 7

Unlike a Chapter 13 Bankruptcy which involves a repayment plan towards debt, a Chapter 7 Bankruptcy is an immediate discharge or wiping out of unsecured debts. Debts that can be included in a Chapter 7 Bankruptcy are credit card debts, medical bills, personal unsecured loans, timeshares, certain tax debts, deficiencies on vehicles and much more.

One of the most common misconceptions about a Bankruptcy is that it will destroy your credit score. The filing of a bankruptcy actually erases the pre bankruptcy credit history which allows the filer a financial fresh start without debt and a fresh start on their credit as well. After a bankruptcy the filer(s) will receive a plethora of offers for credit. Who better to lend money to then someone who is no longer carrying debt?

Our advice is to stay away from any and all new unsecured debt after bankruptcy and allow your savings and your credit score to continue to rise. We have seen credit scores rise over 100 points in the first year after filing and yours can rise too!

Bankruptcy Alternatives

Mortgage Modification & Foreclosure Defense

Oftentimes a hardship such as unemployment, reduction in income, divorce or separation, or unanticipated expenses leads to late or unpaid mortgage payments.

When such a hardship occurs a mortgage modification may be a viable option, especially if other debts (credit cards, vehicle payments, etc.) are substantially current or non-existent. A modification generally results in a change in the interest rate or term of the mortgage and includes the mortgage arrears (amount behind) in the new principal loan amount.

In times when home values are increased, mortgage companies and mortgage servicers lack the incentive to engage in mortgage modification plans and therefore the homeowner is forced to litigate and defend a foreclosure lawsuit.

Our law office has experience in filing Preliminary Objections, Answers, New Matter and Motion practice in the Philadelphia Courts of Common Pleas to keep our clients in their homes using the legal system.

Although every legal situation is different it is always best to contact a lawyer upon receipt of a Notice of Intent to Foreclose or upon service of a Foreclosure Complaint. The earlier an attorney is involved the more legal options and strategies are available to you.

Mortgage Modification & Foreclosure Defense

Debt Consolidation

Also known as debt settlement, debt consolidation involves making a single payment to all your creditors for a reduced amount to what is owed. Our lawyers in Center City Philadelphia work with your creditors to negotiate these payments.

Debt consolidation generally is most successful when there is a relatively high amount of disposable income in comparison to the debt. In this case it can be assured that the borrower is saving enough money on a monthly basis at a pace faster than the debt itself is growing.

Unfortunately, too often a debt consolidation is entered into and only a portion of the debt is satisfied due to lack of sufficient disposable income to reduce the total amount of debt due and owing.

Center City IRS Installment Agreements
